Terms of Use

These Terms of Use govern the relationship between you and Gonçalo Beirão de Mira, who is responsible for MatchWOD (hereinafter «MatchWOD»), regarding your use of the matchwod.com website, the phone and watch app, the web app (app.matchwod.com) and the server that connects them. You accept these Terms when you create an account or sign in. Without an account, the app works only on your phone and only the sections on health, the rules of use, liability and governing law apply.
The processing of personal data is governed by the Privacy Policy, which forms part of these Terms.
Eligibility
MatchWOD is intended for people aged 16 and over. By creating an account, you confirm that you meet this requirement.
Each account is personal and non-transferable. You agree to provide accurate information, in particular your sex, which determines your division on the leaderboards.
Your account
You are responsible for keeping your password confidential and for all activity carried out through your account. If you suspect unauthorised access, you should change your password and end the other sessions in your Profile, or contact MatchWOD.
You may delete your account at any time, in the app or on the web. What happens to your data is described in the Privacy Policy.
Health and training
MatchWOD is not a medical device and does not provide medical advice. Morning readiness, today's headroom, zones, load and the estimates of rounds and repetitions are calculations based on your watch data and on what you log, and may be inaccurate: watches can lose the heart rate reading, and heart rate cannot count repetitions.
You train at your own risk. You are advised to consult a doctor before starting or changing a training programme, particularly if you have a health condition. If you experience pain, dizziness or shortness of breath, stop exercising immediately.
Your content
You retain ownership of the content you create: workouts, recipes, notes, comments and results. To enable the service to operate, you authorise MatchWOD to store it, copy it between your devices and make it available to those you choose: the members and coaches of a community, or anyone holding a link you have shared. This authorisation ends when you delete the content or your account, except for backups until the period set out in the Privacy Policy expires.
Workouts published by a coach in a community belong to the coach or the community. Adding one to your plan creates a read-only copy.
Texts you send us through Help (reports, feedback and texts to improve the importer) may be used to improve MatchWOD and are retained after you delete your account, no longer associated with you.
Communities
Each community (a box or a club) is managed by its administrators and coaches, who decide on the admission of members, the workouts published and the moderation of comments. They may delete comments, remove members and, in an open community, admit anyone.
The integrity of the leaderboard depends on the accuracy of the results. You should only confirm results you actually achieved, in the correct scale and division.
Rules of use
You may not use MatchWOD to:
- post illegal, offensive, threatening, discriminatory or sexual content, or harass other people;
- impersonate another person or create fake accounts;
- submit false results to a leaderboard;
- send spam or unauthorised advertising;
- publish other people's personal data without their consent, or collect data about other users;
- access accounts that are not yours, circumvent the service's limits, overload or attack it, or use automated programs without our prior authorisation.
Moderation and suspension
MatchWOD may delete content that breaches these rules and suspend the account of anyone who abuses the service. Suspension ends all active sessions and prevents signing in, but your data is retained; once the suspension is lifted, access is restored as before. In serious or repeated cases, the account may be closed.
Wherever possible, MatchWOD will inform you of the reason for its decision. If you believe the decision was made in error, you may request a review by writing to info@matchwod.com.
You may report comments and block other people within the app. Every administrative action is recorded in an audit log.
Premium
Some features are reserved for Premium. Premium is not currently sold: it is granted by MatchWOD or included for the administrators and coaches of a Premium Box, and this may be withdrawn.
Losing Premium never deletes data: your records remain, and only the Premium features cease to be available.
Once Premium becomes a paid service, the price, renewal, cancellation and your right to withdraw from a distance contract will be set out in these Terms and in the store before you purchase, and purchases made on the App Store or Google Play will also be subject to the rules of the relevant store.
Availability and development of the service
MatchWOD is under active development and may add, change or remove features. If a change removes something important to you, you will be notified in advance in the app or by email.
MatchWOD makes every reasonable effort to keep the service available, but outages, maintenance or loss of network connectivity may occur. Without a network connection, the app continues to work on your phone and syncs later. You are advised to keep a backup (Profile → Backups) of any data you do not wish to lose, as matches, RPE and block notes are stored only on your phone.
If MatchWOD closes, you will be given at least 30 days' notice so that you can save your data.
Intellectual property
The MatchWOD name, logo, app and website are the property of MatchWOD. You may use them only for the purpose of using the service, and may not copy, resell them or create a similar app. Third-party fonts included in the app are subject to their own licences, listed in Profile → About → Licenses.
Apple, Google, Health and Health Connect
The app accesses Health, on iPhone, or Health Connect, on Android, with your permission and allows you to sign in with Google or Apple if you so choose. These services and the stores from which you installed the app have their own terms, which also apply.
These Terms are concluded between you and MatchWOD, not with Apple or Google. Neither is responsible for the app or its content, nor for its maintenance, support or any claims relating to it, but each may enforce these Terms insofar as they concern it.
Liability
MatchWOD is provided free of charge and on an «as is» basis. To the fullest extent permitted by law, MatchWOD is not liable for indirect losses, for training decisions you make based on the figures shown in the app, or for data lost without a backup.
Nothing in these Terms limits the rights granted to you by law as a consumer, nor MatchWOD's liability for wilful misconduct, gross negligence, or harm to life, body or health that it causes.
Termination
You may stop using MatchWOD and delete your account at any time. MatchWOD may close your account if you breach these Terms seriously or repeatedly, or if the service closes, as described above.
Changes to these Terms
If these Terms are amended, the version and date at the top will be updated. Material changes will be notified in the app or by email before they take effect, and the app will ask you to accept them again. If you do not accept them, you may delete your account.
Governing law and disputes
These Terms are governed by Portuguese law. If you are a consumer residing in another European Union Member State, you retain the protection afforded to you by the law of your country of residence.
If you have a complaint, please contact MatchWOD first. You may also refer the matter to an alternative consumer dispute resolution body, such as CNIACC (cniacc.pt), or to the competent courts.
